New Jersey – -(Ammoland.com)- July 11, 2018. ANJRPC’s federal lawsuit to overturn Governor Murphy’s firearms magazine ban is starting to pick up speed. There has been a flurry of activity since the court scheduled an expedited hearing on Association of New Jersey Rifle and Pistol Clubs’s request for an injunction (to halt enforcement of the ban until the case is decided).

The State of New Jersey was first to oppose the injunction motion, arguing among other things that the newly banned magazines are “dangerous and unusual weapons” not protected by the Second Amendment, which pose a danger to the public even in the hands of law-abiding citizens. The State also argues that the banned magazines are not needed for self-defense, but are “perfectly suited for illicit use.”

“Claiming that banned magazines are not needed for self-defense while simultaneously exempting their use for the protection of lawmakers is outrageous and the height of hypocrisy,” said ANJRPC Executive Director Scott Bach. “This elitist double standard is irrational, indefensible, and shows the utter contempt New Jersey has for its ‘subjects,’” said Bach.

Piling onto the State’s papers, the Giffords Law Center and Everytown For Gun Safety filed their own opposition to the injunction motion, arguing among other things that standard capacity magazines are best suited for military use, that NJ’s prior regulation of magazine capacity for several decades makes the new ban presumptively valid, and that the ban will make mass shooting incidents “less lethal.”

On July 9, Association of New Jersey Rifle and Pistol Clubs ripped all of these arguments to shreds in a reply brief filed in the case.

This case was filed in cooperation with the National Rifle Association. “We thank the NRA for its incredible support and guidance, which made this aggressive lawsuit challenging the magazine ban possible,” said Bach.

    1. I have a long-time friend who owns a gun dealership in the state where I reside. He moved to the armpit state two years ago-more $$$ than he could pass up, so don’t go making disparaging remarks. He sends me news articles occasionally that he finds relevant to me and him as 2A supporters. Something that has stood out to me while reading them is that the legislators and leaders from the bottom up is how they invariably refer to their constituents as “subjects”. Last time I checked “subjects” were either serfs under dictators or monarchs, or what students studied in school. And somehow I don’t believe those politicians are referring to math or reading.
      Just an old geezer’s observation.

Can someone please explain why it is that most gun rights groups skim over the OBVIOUS wording in 2A which makes it clear as glass that qualified, trained citizens should be allowed the same armament (arms) as the (possibly in the future tyrannical) government? This was the primary original intent and is as clear to most of us now as it was to the founders when they put pen to ink.
      It irks me no end when otherwise great 2A support groups and organizations pussyfoot and dance around this fact. And it is obviously the one issue that the power-hungry leftist gun- grabbers fear the greatest. Well that along with the rest of the Constitution. Pesky piece of parchment that it is!

Each state has a mechanism for removing corrupt officials by way of Grand Jury Investigation, Indictment and Prosecution but it ALL starts with the citizens with backbone stepping up to the plate and moving forward with a Notice and Demand against the corrupt heathens and then moving forward with a charge of Willful Neglected of Statutory Duty through grand jury indictment. Many may not realize it but this is an extremely high crime!

      1. We do not need to enforce the laws on the books. Those laws are a violation of our rights. We do not need the 1934 NFA, 1938 law 1968 GCA and more., Brady Bill or any of the laws in the states.

      1. Politicians, judges, and bureaucrats at the federal, state, county, and city level do not want to admit that the Second Amendment is a Constitution level control on all governments. The Second Amendment expresses the founders intention to fill the legal field regarding arms. The Founders preempted future Congresses, presidents, bureaucrats, the states, counties and cities, and the entire judiciary from making laws, rules or regulations regarding arms.

    9. dummies forget that SCOTUS just recently declared in a case they decided that weapons of military use ARE precisely what “arms” means in that pesku Second, and thus the AR and similar cannot be banned as they ARE weapons of military use. Same with the little “buckets” that hold the bullets so those weapons of military use can fire them.

      There have been a number of recent mass shooting cases (Parkland FL, Sutherland SPrings TX are two come quickl to mind,) where the perp used ten round mags, the “magic number” above which we cannot go without seeing blood in the streets next week. A competent rifleman can shange a magazine in about two and a half seconds and be ready for his next round. So WHAT exactly, is the big deal with mag capacity? People thought the M 1 Garand was “cheating” when it came out with an eight round magazine capacity, quickly refreshed by simply plopping a new “clip” of eight new rounds into the bay and relesing the bolt. All the military weapons to that point only had FIVE…. so eight was a no-fair “advantage”.

      All the stypid nannies need to get a dose of real life. Let THEM walk around Chicago, Baltimore, Trenton, and see how long they can survive before getting assaulted…….. oh, and leave the paid armed bodyguards home.

    13. A Magazine is not a weapon as it says in the article. A magazine is only a piece of the whole. As a piece of equipment, a magazine cannot be a weapon by itself. It is like a container full of sugar cubes. Or a 24 pack of pepsi. A magazine only is the holder of something.

      1. @john- just fir kicks I loaded up one of my 20 round AR10 mags and beat a fiberglass shower enclosure to death with it. It proved to be quite dangerous to that enclosure, but a hammer or baseball bat would have been a better choice. And as you can orobably guess, not one round went off during the entire time. A few did escape though and it was really kind of fun. I truly don’t believe any of the crazy crap NJ or CT or Mass will stand up under scrutiny by a Constitutionalist SCOTUS. Appellate Circuit Court decisions are a different story, but there are enough legal firearms owners to bring this to SCOTUS eventually.
        For now anyone who lives in NJ or any of these other loony tunes states can ship any and all of those yucky banned firearms, large capacity magazines, and that big bore ammo to me. I PROMISE I’ll give them all back when they get the laws changed back to something more in line with 2A. Honest, cross my heart and hope to die.

      They need to be fired at the next elections and the Gov. has to be recalled if legal to do so,

        1. I thought you might be former LEO from some of your posts. Is that the case, or are you just that well versed in the laws re: civil rights? I had to go back and reread 42USC1893 after mistakenly stating the necessity of an arrest fir it to come into play. You were absolutely correct. Also, do you do much long range shooting?

      1. In the days of the Founders, they used a process called “Civil Disobedience” to great effect. And, when the British Army was dispatched under orders to sweep MA and confiscate firearms and munitions in the hands of colonists, they were met with “a shot heard ’round the world”.

      Magazines are protected in our Bill of Rights just as much as rifles, handguns, ammo, or knives.
