Hammond Indiana Man Gets 18 Months in Prison for Firearms Straw Purchase

HAMMOND – -(Ammoland.com)- Darryl Ivery, Jr., 24, of Hammond, Indiana, was sentenced by United States District Court Chief Judge Jon E. DeGuilio after pleading guilty to making false statements in connection with the acquisition of firearms, announced the United States, Attorney Clifford D. Johnson.

Ivery was sentenced to 18 months in prison followed by 1 year of supervised release.

According to documents in the case, between February and August 2020, Ivery purchased a total of 26 firearms on 17 different occasions from federally licensed firearms dealers in Lake County, Indiana. In each of the transactions, Ivery falsely certified on federal forms that he was the actual buyer. In reality, Ivery purchased the firearms for other individuals from Chicago, who paid him between $100 and $800 over the cost of the firearms to make the purchase. Law enforcement has recovered seven of the firearms: six in Chicago and one in Gary. Five of the firearms were recovered by law enforcement within one month of purchase, and one was recovered at the scene of a shooting.

This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Chicago Police Department, and the Gary Police Department. This case was prosecuted by Assistant U.S. Attorney Nicholas J. Padilla.

This case was prosecuted as part of the joint federal, state, and local Project Safe Neighborhoods (PSN) Program, the centerpiece of the Department of Justice’s violent crime reduction efforts. PSN is an evidence-based program proven to be effective at reducing violent crime. Through PSN, a broad spectrum of stakeholders work together to identify the most pressing violent crime problems in the community and develop comprehensive solutions to address them. As part of this strategy, PSN focuses enforcement efforts on the most violent offenders and partners with locally based prevention and reentry programs for lasting reductions in crime.

A well regulated militia, being necessary to a free state, the RIGHT of the people to keep and bear arms SHALL NOT BE INFRINGED. The second amendment, THE law of the land. It does not matter if the buyer is a dirt bag. Does not matter how many guns the man bought, if he bought them for someone or who he sold them to, the man has every right (and obligation) to keep and bear arms under the constitution. Rubbish. Those with such disregard for the safety of others should remain prohibited from buying, owning or otherwise possessing firearms of any kind.

I’m thinking that there are many that have complete and utter disregard for the safety, health, and even existence of others, but they have not , yet, committed a crime. Should they be prohibited from buying, owning, or possessing. Soros, Blumberg, and Gates are prime examples.

And then there are the reformed, the history of American law has tolerance for those that have paid their debt to society. Permanent gun rights disability added to a state sentence is a relatively new concept and a huge infringement on the 10th Amendment police powers of the various states.

Says nothing about dirt bags, murderers, corrupt cops and politicians etc. If you are not in jail or the loony farm then you have every right and obligation to keep and bear arms. Robbers, murderers, cartel operators, terrorists, druggies etc. all tend to die of natural causes —— natural to their line of work. Should say just the opposite. The case was investigated by the Chicago PD and the Gary PD and then handed over to the BATF. Everyone involved was a oath breaker. So the 24 year old who was convicted of this NON CRIME, no victim, no crime now has his life ruined for being a entrepreneur in a prohibited business.

It’s incredible how many people believe the BATFE and Democrat politicians are the only bad guys.

That was part of my point – the BATFE, Democrat politicians, most Republican politicians, and a certain percentage of enforcers (including you, when you were an enforcer) are the bad guys.

When “they” shoot the dentist’s dog, point guns and scream obscenities at his wife and children, handcuff him, and tear his house apart looking for something he bought legally and with which he did nothing wrong, the dentist and his friends won’t be thinking about politicians.

Amazing. You’re against stopping bad guys being deniied guns. You’re OK with the killings, robberies and assaults. Good guys should be cheering the ATF for enforcing existing laws.

But Don, the point that we have been trying to make is that laws infringing on gun rights are unconstitutional. Any statute that is contrary to the Constitution ( the Bill of Rights is part of the Constitution) is null and void. Please see Marbury v. Madison.

Catch, convict, and incarcerate or execute the dirt bags, killers, and robbers. The knowledge of sure punishment reduces crime to near zero; there would be no gangs; and all around bad guys would keep themselves in check.

biggest problem for that to work , das need to be honest, and police too in florida we had 17 cases of people on death row who could not have committed the crime proof was hidden by prosecution, so the crime of intensionally persecuting someone needs to be added to keep the enforcers honest with death as only punishment

Many don’t want some “existing laws” (the ones that are clearly unconstitutional) to be enforced.

That group of people wants murderers, robbers, and other violent criminals arrested, prosecuted, convicted, and incarcerated. That group would like those criminals to remain incarcerated for an appropriate amount of time. That is not happening. A certain percentage of enforcers are busy enforcing gun laws, mask mandates, and harassing people who have done nothing wrong.
