U.S Senate Considering Criminal Investigations for Innocent Gun Owners?

National Instant Criminal Background Check System NICS
National Instant Criminal Background Check System NICS

Washington, DC – -(Ammoland.com)- S. 675, the NICS Denial Notification Act of 2021, is gaining traction in the U.S. Senate.

We urgently need your help to shut this gun control bill down!

The NICS Denial Notification Act would open criminal investigations into 100% of background check denials, even though government studies show 9 out of 10 times these denials are false positives. Passage of this language would result in criminal investigations into TENS OF THOUSANDS of innocent, law-abiding Americans for the non-crime of being denied a gun purchase by a broken background check system each year.

Tell your Senators right away NOT to expand this abysmally broken system.

Who is behind this?

If you’re from Illinois, Alaska, Connecticut, Delaware, Florida, Iowa, Maine, Minnesota, New Hampshire, Oklahoma, Pennsylvania, South Carolina, Texas, Vermont, or West Virginia, your Senator is a part of the problem here!

Here is a full list of the Senators who openly support opening criminal investigations into innocent Americans over false-positive NICS denials:

  • Sen. Coons, Christopher A. (D-DE)
  • Sen. Cornyn, John (R-TX)
  • Sen. Duckworth, Tammy (D-IL)
  • Sen. Rubio, Marco (R-FL)
  • Sen. Carper, Thomas R. (D-DE)
  • Sen. Lankford, James (R-OK)
  • Sen. Klobuchar, Amy (D-MN)
  • Sen. Collins, Susan M. (R-ME)
  • Sen. Manchin, Joe, III (D-WV)
  • Sen. Toomey, Patrick (R-PA)
  • Sen. Graham, Lindsey (R-SC)
  • Sen. Shaheen, Jeanne (D-NH)
  • Sen. Grassley, Chuck (R-IA)
  • Sen. Leahy, Patrick J. (D-VT)
  • Sen. Blumenthal, Richard (D-CT)
  • Sen. Murkowski, Lisa (R-AK)
  • Sen. Durbin, Richard J. (D-IL)

If any one of these Senators is yours, they will get an extra scolding from our action alert! If one or more of your Senators is not already a co-sponsor, then it is essential that you send them a warning before this legislation picks up any more steam.

Prosecution of NICS Denial Cases

Of the few legitimate cases brought by the government each year, a Government Accountability Office (GAO) study revealed that prosecutors have a difficult time prosecuting these cases due to a lack of evidence because these cases are “not appealing to judges and juries from a public safety standpoint,” and even incurring jury nullification (Page 28).

Further, state police reported it was more important to keep officers on traffic duty than to recover firearms potentially transferred after 3 business days to a prohibited person who underwent a background check.

People who willingly submit to background checks are not dangerous individuals. Instead, dangerous criminals overwhelmingly chose to obtain their firearms illegally.

We need to make sure the Senate understands this!

NICS’ Outrageous False-Positive Denial Rate : FAIL

Moms Demand gave tickets away for “free” to its event and still drew only “around 40” attendees.

The overwhelming majority of National Instant Criminal Background Check System (NICS) denials are false positives. A 2016 “audit” of cherry-picked or “judgmentally selected” NICS checks was used by the Obama Administration’s Federal Bureau of Investigation (FBI) to claim a denial “accuracy rate that ranges from 99.3 percent to 99.8 percent.”

However, information obtained by Gun Owners of America pursuant to a Freedom of Information Act (FOIA) request shows the FBI’s records undermine its own claim:

“27.7 percent of [NICS] appeals received during the requested time period were overturned and the firearm purchase/transfer transactions were proceeded.”

Research by Dr. John Lott of the Crime Prevention Research Center has compiled several government reports which reveal the overwhelming failure of NICS false-positive denials.

In 2009, the Federal Bureau of Investigation (FBI) denied 71,010 individuals at the gun store, but only 6.6% (4,681 individuals) were referred for further investigation by ATF field offices. A Department of Justice report stated:

“The remaining denials (66,329, or about 93%) did not meet referral guidelines or were overturned after review by Brady Operations or after the FBI received additional information.”

Of those ATF field office investigations, 51% (2,390 individuals) were of delayed denial cases, not initial denials. 572 of these were admitted to “not [be] a prohibited person.” This leaves 4,154 legitimate FBI denials in 2009, resulting in a false-positive denial rate of roughly 94.2%. Tell your Senator about the outrageous false-positive denial rate of the NICS background check system today!

This is only with the data released and assumes there were no ongoing record-keeping errors still present in government databases at the time of the report’s compilation. Data from 2010 is extremely similar.

A Washington Post report broke down the false-positive denials into the following categories:

  • 10.1% “not a prohibited person,”
  • 8.4% “no potential or unfounded,”
  • 10% “closed by supervisor,”
  • 35% “no prosecutorial merit;” and
  • 23% “guidelines not met.”

At the federal level, less than one hundred NICS denial cases are prosecuted a year. This is because ATF declines to prosecute these cases. Point of Contact states which run their own NICS checks also prosecute very few cases. Later data provided in a GAO report to Congress also revealed a high error rate and a corresponding minuscule prosecution and conviction rate (Page 22).

Who is Being Falsely Denied?

False-positive NICS denials are so common that many GOA members, their friends, and their families have experienced them. Imagine if everyone you know was falsely denied on a background check also had to deal with a joint federal-local criminal investigation.

Please contact your Senators right away and tell them to stay far away from this anti-gun owner language!

9 out of 10 times NICS is falsely denying law-abiding citizens. It could be just about anyone!

Senior citizens, who despite serving their country honorably in the military, are prevented from buying guns because of misdemeanors from their teenage years. Military veterans, who suffer from PTSD and who have guardians handling their finances, are flat-out denied by NICS. And then there are upstanding Americans, like CA Sheriff John Lopey, who have no idea why they are denied a gun purchase by NICS.

What should Congress do?

Congress MUST PROTECT the right of law-abiding Americans to purchase firearms.

Given that the NICS background check denial rate has so many false positives, the next step is certainly not to use those false positives to open criminal investigations.

Don’t let your Senator support this anti-gun owner and gun control language.

Naturally that back stabbing fudge packer lindsey graham is on board along with rubio who never met a constituent he would not sell out.

How do these TRAITOR assholes keep getting re-elected?

I guess they would have to investigate Hunter Biden then. The slugs don’t investigate some cases that aren’t questionable, right sleepy?

Sen. Cornyn, John (R-TX)
Tyler, TX

Tom Horn

Thanks. Unfortunately, my Senator and Tyler is in my area. I’ll be giving them a call. I’ll follow up with an email too.

Thanks Tom!

Calls matter – the other side is much more vocal than people who believe in firearm rights.

Why all the downvotes?

You must remember Cornyn’s valiant defense of rights protected by the 2nd Amendment on February 28, 2018:

What a dynamo.

Since you asked, you claim to be the cognoscenti of logic, yet few are as emotional as you are. You talk down to people, yet by almost any measure of success you are inferior, and that fact come out in your writing. If you were any modicum of a man, you would apologize and start over … or just go elsewhere.

I don’t claim to be “the cognoscenti of logic.” I’m not emotional. I remain calm when you lie and just point out your lies and ask questions. I don’t talk down to people. Why do you say “by almost any measure of success you are inferior, and that fact come [sic] out in your writing” – why do you say I am inferior? Inferior to whom and by what measure of success? “If you were any modicum of a man, you would apologize and start over … or just go elsewhere.” ~ Wild Bill Apologize for what? You are in denial. You are not ready for personal growth.

“You are in denial. You are not ready for personal growth.” ~ Wild Bill Again, you make vague, high-level assertions and then walk away from your view when challenged. Here is the real issue: My purpose here is to advocate for freedom.   Freedom for people to keep their firearms.   Freedom for people to keep the fruit of their labor (less a small amount for limited government services).   Freedom to live in a country that has boundaries and rules that are enforced equally to regulate who enters the country, how long they can stay, and under what conditions.… Read more »

If your purpose is to advocate freedom, then you are failing that too, because you work vitriol against cops into nearly every comment.
For personal growth, you need to introspection.

“If your purpose is to advocate freedom, then you are failing that too, because you work vitriol against cops into nearly every comment. For personal growth, you need to [sic] introspection.” Most totalitarian regimes for more than 100 years were police states. Totalitarianism in the Unites States is only possible with a police state. If police have the unconditional support of those in their community, most of them will enforce any law they are ordered to enforce. You may be able to grow if you compare what is happening in the U.S. to what happened in totalitarian countries. If someone… Read more »

Denial, denial, denial. You are in denial.

You can put your fingers in your ears, close your eyes, and chant that incessantly. However, your continued resistance to discuss issues is telling.

Sir, I am interested in what percentage of law enforcement and by that I mean city, county and state LEO’s fall into the category you would consider bad. When I read this statement from you, “I point out things bad cops do. If there weren’t so many bad cops doing bad things, I wouldn’t have much to point out” It implies to me something I don’t want to take for granted so maybe you could expound more specifically on that.

I don’t know what the exact percentage is (obviously), but would you say the following things are “bad:” Stealing funds donated to the FOP; After a hurricane, stating: “No one will be able to be armed,” and, “Guns will be taken. Only law enforcement will be allowed to have guns.”  Forcing entry into an elderly lady’s home after a hurricane and, after she says she’s fine and doesn’t need any help, and asking her if she has a firearm. When she retrieves the firearm (an old revolver), they break her shoulder in two places, chip one of her teeth, and… Read more »

Absolutely I would. I am not trying to trick you, I am just trying to understand if you think most, some or few are bad. I will share with you that I am a full time pastor of a mid size church in a suburban location and the chaplain to the police department. There are about 100 officers on the force and I know them all fairly well. We just offered them our facility for ongoing training that was called, “Duty to intervene” where they were instructed that it is their duty to intervene if they see another officer doing… Read more »

I didn’t think you were trying to trick me. I appreciate your comments. It would be interesting if you could spend a day with one of the LEOs you believe would not follow orders to enforce future gun laws such as registration of semiautomatic rifles. You could review one video after another of LEOs doing bad things and their partners not intervening (or worse, their entire department covering up the crime for them). You could ask the LEO for his/her impression on each video. At the end of the day give the LEO this scenario: A law is passed requiring… Read more »

I understand where you are going. In my experience, the real issue in the police departments is when their loyalty to one another interferes with their oath to the public they serve. That problem is made worse when people disparage them all because of the actions of a few. That just perpetuates the us vs them mentality. The reality is, these men and women are tasked with making life and death decisions in spit seconds and the overwhelming majority of the time they make the right call. Having said that, there will always be people in it for the wrong reason… Read more »

I’ve posted it before, but in case you missed it – in 2020 I was part of a small group of counter protestors (I believe there were less than a dozen of us) in a small town. Four hundred BLM, Antifa, and nutty white women marched through the streets with signs such as ACAB, justice for George Floyd, etc. Our little group stood as those hundreds of BLM, Antifa, and NWW marched past us, just a few feet away. My sign had written on it: I Support All Good LEOs [in large letters] Defund Philip Brailsford [in small letters, at… Read more »

I too support all good LEO’s and the defund the police folk (not saying you are) would be very sorry if they got their way.
Have a peace filled day sir, time to go back to work.

I’m definitely not in favor of eliminating police.

I am in favor of police reform, including changes to not-so-qualified immunity.

I do encourage police to read as much history as they can about totalitarian regimes and how they came into power and how they stayed in power.

Have a nice day.

Would you say that what Langley and Brailsford did was “bad?”

The government is and was way out of bounds here. I was waiting for my background check to clear to obtain a gun even though I have a CCW. There was a gentleman in front of me who was waiting for his check to clear so he could get his gun. But the eye did.

Progressives of all flavors in America have learned some valuable lessons from OUR adversaries, you know, the people we fear and fight against but whom the progressives admire. Here is your list: National Socialists, the Communist Chinese, Communist Cuba, Communist Venezuela and most of all the former USSR. They admire these totalitarian regimes because these regimes ‘get things done’ in the political arena. Genocide. Oppression. Totalitarianism. So it is no wonder progressives in America look to these regimes to find ways to oppress and terrorize their own people. Her e is one for you: show me the man and I… Read more »

Anti-Constitutional need I say More?

I voted for Cornyn many times but not in ’20 and never again. He was never willing to vehemently support the republic against those who would weaken it but it was him or a communist. Fact is they’re the same and Cornyn counts on that. I’m shocked that other GOP members share his ignorance.

Toomey has to lift Joes BALLS to breathe !

Been a useless piece of scum for years, rules by way of the wind flows, and talks out both sides of his mouth, glad he is RETIRING, goodbye and don’t let the door hit you in the a-s!

No doubt such legislation is crafted to discourage buyers, and especially new buyers who may be unsure of the process to begin with. And to antagonize those that believe in their God given rights. Prayer works friends.

Well, now I’m torn. For years, we’ve been ridiculing their lack of sincerity by pointing out that their failure to prosecute actual criminals who fail background checks shows that they are not really serious about taking criminals out of circulation, but just interested in harassing gun owners. For example: “Obama needs to look in a mirror before urging others to work harder. In a typical year (2010), his EXISTING background check system denied over 72,000 gun purchases for such causes, but his Justice Department prosecuted only 62 of those criminals… and convicted only 13. Most of the rest were simply… Read more »

I’m in agreement with you on the bad optics. We do need to go after the ones who are prohibited and lied on their answers on the form. I guess that’s the rub, isn’t it? How do you figure out who lied on their form without harassing those for whom it was a false denial? What bothers me about I a bill like this is that it is ripe for abuse in the less gun-friendly locals. There it could be used as cover to implement the politics of back-door gun control in the form of harassment by those “allowed” to… Read more »

Noticed the “down vote “ button works very well, but not the “up vote “ button.
What’s going on, Ammoland?

Just worked for me.

This and no other is the root from which a tyrant springs; when he first appears he is a protector.

Seems to me if the AFT is busy investigating non-crimes that the US Attorneys won’t prosecute anyway they will have less time and manpower to harass gun owners for other stuff. FWIW that’s the real reason the AFT doesn’t put any effort into investigating the ones they already get referred to them. US attorneys are only interested in prosecuting the “big cases.” In my district you can get busted with several kilos of cocaine and the Feds won’t prosecute you but instead will refer you to the state for charges because the US Attorney here isn’t interested in such small… Read more »

Comment on hold.

Ammoland, please consider releasing my comment – it includes phone numbers for all the Republican senators who support this legislation and some suggestions for people who want to get involved.

I see the downvoters are at their post, as always.

The skiing was great today – sunny, in the 20s the whole time, not many people on the mountain, and our group was able to get a late lunch with no waiting. We talked about politics and put together some action plans.

Consider getting out tomorrow and get some vitamin D – you’ll feel better.

hard to believe we have this group of small insecure people , but le attracts people who feal that, way gun and badge make them impotent , to be fair there are some who get in le to save the world….good luck with that

Only surprise is that there were not more Republicans. For those people who would like to dip their toe into activism and make a phone call, their contact information is listed below.   If you are only going to contact one person, I suggest Cornyn. If you are only going to call him at one number, I suggest the Tyler number. I understand there are some people out that way that consider themselves “pro 2nd Amendment,” but never even call their senators.   A few suggestions: I call during business hours and keep calling different offices until an actual person picks up the… Read more »

Progressive Republicans and democrats in tight races will lay low until after Nov 2022 and then they will rise out of the swamp scum and stab us in the back. The Fraternal Order of Police frequently gets involved in politics.

Maybe the Fraternal Order of Police Texas Lodge could make a statement to Cornyn.

They may not be able to do a lot of lobbying because they are a little short of cash right now, but at least they could make a statement:
