At the 2024 Federalist Society Conference, David Thompson, managing partner at Cooper & Kirk and one of the nation’s foremost litigators, working directly with the Second Amendment Foundation, delivered a compelling defense of the AR-15 rifle.

With 44 million AR-15s owned across the U.S., Thompson dismantled the narrative that the rifle’s “lethality” justifies banning it, highlighting how such arguments ignore the Second Amendment’s purpose, legal precedent, and the role of firearms in preserving freedom.

Thompson’s speech not only educated but also energized pro-Second Amendment advocates, reminding them that technological advancements in firearms are a feature of liberty, not a flaw.

Lethality: The Anti-Gun Argument

In his speech, Thompson addressed the growing trend among anti-gun advocates and lower courts to label firearms like the AR-15 as “too dangerous for civilian ownership” due to their perceived “unprecedented lethality.” This argument has been weaponized to support bans on AR-15s and standard 30-round magazines, which are owned by millions of law-abiding Americans.

Thompson called this narrative both factually and constitutionally flawed.

“The entire history of firearms is the relentless, continual search for more lethality and more accuracy,” he explained. “These are instruments that determine your life or your death, whether you live free or as a slave.”

This focus on a firearm’s potential danger shifts the legal conversation away from its common use by law-abiding citizens, a cornerstone of the Supreme Court’s Heller decision.

The Supreme Court’s Clear Guidance

Thompson’s analysis rooted itself in precedent, particularly the Supreme Court’s 2008 Heller ruling. That decision established that firearms commonly owned by law-abiding citizens for lawful purposes, such as self-defense, cannot be banned.

By this test, the AR-15, which is overwhelmingly used for self-defense, target shooting, and hunting, is protected. “99.999% of AR-15s will never be used in any criminal activity,” Thompson said. The rifle’s popularity and lawful ownership place it firmly within the Constitution’s protections.

Thompson also addressed claims that AR-15 rifles are “military weapons” unsuitable for civilian use. He explained that AR-15s are semi-automatic, firing one bullet per trigger pull, unlike the fully automatic firearms used by militaries. Far from being “too dangerous,” the AR-15’s design makes it accessible, accurate, and effective for civilians defending themselves or their families.

The Founders & Firearms Evolution

Thompson dispelled the myth that the Founders couldn’t have envisioned modern firearms like the AR-15. He pointed to historical records, including a 1775 demonstration before the Continental Congress of a firearm capable of firing 20 rounds without reloading. This early innovation proves that the Founders were aware of—and embraced—advances in firearms technology.

Justice Antonin Scalia echoed this sentiment in Heller, ridiculing the idea that the Second Amendment protects only firearms existing at the time of the Founding.

“The Constitution protects advancements in arms as much as it protects advancements in speech or the press,” Thompson said.

AR-15 Bans: Misguided & Dangerous

A major flaw in anti-gun arguments, Thompson noted, is the attempt to redefine the Second Amendment’s protections by focusing on criminal misuse of firearms. Courts have entertained the idea that AR15 weapons and similar firearms can be banned because criminals might use them in harmful ways. But Thompson emphasized that the Constitution was designed to protect law-abiding citizens’ rights, not to cater to hypothetical abuses.

“The features of the AR-15 that make it accurate and effective for self-defense are the same features being twisted into reasons to ban it,” Thompson argued. “The focus should always be on how these firearms empower law-abiding Americans—not on how criminals misuse them.”

A Broader Lesson: Why Lethality Matters

Thompson’s most profound point may have been this: the Second Amendment was written precisely because firearms are effective tools. Their lethality is not a constitutional bug—it’s a feature. Citizens need reliable, effective firearms to protect themselves, their families, and their communities.

“Lethality isn’t the problem,” Thompson said. “It’s the solution when it comes to defending your home or your freedom.”

He warned that using lethality as a reason to ban firearms undermines the Second Amendment’s purpose and sets a dangerous precedent that could erode other rights.

Excellent video and a clear, concise presentation of exactly what the 2nd amendment means and preserves. I really liked the position he took regarding insurance and the usage of it. Maybe I really don’t really need the lethality of an AR-15. I’ll just stick with an AR-10 instead; and make everyone happy. Or, instead of AR-15, I could just get an M-15 from Armalite. At least my Mini-14 isn’t an AR, so I guess that’s okay with everyone.

If the 5.56 – 223 is so lethal, then why are other cartridges being ” invented” for use in the AR-15’S? What about the Remington model 740? And the Remington model 8 (1906) in 25 Rem., 30 Rem., 32 Rem., 35 Remington.? And the first successful gas operated semi auto, the Standard Arms model G, made in 1912. I don’t own a single “AR15”. I do, however have few Aero X15’s and an M5, a couple of AM15’s(aka poverty ponies). A PSA Brandon 15(FJB meme lower) and PA10. None of those super deadly AR’s in my safe.

I have one of those FJB PSA lowers too! I paired it with a Bear Creek Arsenal .556 NATO Side Charging 10.5” Stainless Steel barrel. It’s a fantastic combo.

Mine has a Right To Bear Arms dedicated .22LR upper that runs great. Any issues with the BCA upper. I built another rifle with a BCA .450 Bushmaster upper, It runs good after I tightened the set screws on the gas block, but I haven’t really shot it enough to encounter any problems. .450 BM is a little pricey..

That’s funny. The only issue I have had with my BCA upper was a loose gas block. I sent it back and they fixed it properly and I had it back in 7 days! I live on the Pacific Northwest Coast too.

Their customer support is very good IMHO. Of course, they have critics, but the way I see it mistakes happen and how you deal with them separates you from the chumps.

I would like to buy a .308 side charging upper from them but right now those are restricted in my communist state.

Wow, I’m a Kommiefornia subject and I can honestly say that Washington’s “assault weapon “ laws are worse. I just have to configure my guns in the “right” way (which is easily undone) and I can still have pretty much any rifle. Your handgun laws are still better as far as I know. Maybe both of our BCA uppers had final assembly done on a Friday or a Monday. I wouldn’t want to stake my life on a BCA in war(unless it was my ONLY choice), but for applications like plinking or hunting where you’re not putting hundreds or thousands… Read more »

Does AM in AM15 refer to Anderson Manufacturing, or something like that? ie – generic lower from specific manufacturer. Unfortunately I don’t think banners distinguish that way. However – when NSSF comes up with number of AR15’s sold in last 20 years (~24M I think) – do they count generics, do they count stripped lowers or even assembled lowers? Do they just count complete rifles sold? If so real count is quite a bit higher. Not even accounting for 80% lowers… I waited too long – so have no FJB lower. Yes AM15 refers to Anderson Manufacturing and that was mostly tongue in cheek. To me it shows how little the anti gunners actually know about guns. AR15 was(and maybe still is) a a trademark of Colt. That’s probably why the media always says “AR15 Style rifle” when reporting shootings. My guess about the NSSF numbers is that counts complete rifles, complete lowers and stripped lowers as they are all serialized and considered firearms by the government. Do you know if the NSSF gets those numbers from the industry or from the ATF via 4473’s? I don’t think PSA will bring… Read more »

Silver Creek, The Winchester 351 WSL rifle actually uses a simple blowback system. No gas system at all. The knob sticking out the front of the forearm is the charging rod/mechanism to load a round from the little magazine. BTW, Legend has it there were some 351WSLs at the Bonnie and Clyde ambush.

I have one. The gun is so heavy, (nothing but beautiful nickle steel and walnut), that shooting it has less recoil than shooting an AR-15. And it is a beautiful piece of skill and workmanship. I just wish ammo wasn’t so expensive.

The storm was pretty intense mostly North and East of Seattle. I was hoping that it would be more intense in Seattle but that was not the case. I know of only 2 fatalities. A homeless woman in Lynwood, north of Seattle, died when a tree fell in an encampment. Another lady who was taking a shower died when a tree fell on her bathroom, again north of Seattle.
