Virginia Advice for Out-Of-State CHP Holders

Terry McAuliffe
This is NOT about you or anything you have done that was wrong. It’s about our Governor, Terry McAuliffe, and our Attorney General, Mark Herring, who were both elected by a very small margin, and are a great embarrassment to Virginians.

First, I’d like to offer an apology to our fellow CHP holders from the 25 states that are about to lose recognition from Virginia on February 1st 2016.

All of you who have visited Virginia over the years have been exemplary and have not caused any problems within the Commonwealth.

This is NOT about you or anything you have done that was wrong.

It’s about our Governor, Terry McAuliffe, and our Attorney General, Mark Herring, who were both elected by a very small margin, and are a great embarrassment to Virginians. Neither of these individuals are reflective of the attitudes toward liberty and freedom and the values that we cherish here in Virginia. In fact, both have been referred to as “lawless” by some of our own General Assembly members, many of who are going to work to fix the situation we find ourselves in.

Here in the Old Dominion, the anger of gun owners at what our Attorney General has done is palpable, and I cannot remember anything to match it. Herring and McAuliffe have endangered your lives when you travel here and our lives when we travel outside of Virginia.

SIX MILLION CHP holders in half the country are affected!

And all this treachery was done as political payback to Michael Bloomberg for campaign contributions.

VCDL will be working to fix this problem from various angles and we will be trying to do so as expeditiously as possible. We want Virginia to be a welcoming state again for our fellow gun owners. We ultimately want to recognize ALL out-of-state permits.

Sadly, we understand if you decide you can’t visit us until we can honor your permits. I’d be a hypocrite if I said I would do so if the tables were turned.

HOWEVER, you do have a few options if you still want to come visit us:

  • 1. Open carry is legal in Virginia – no permit required and you can open carry in most places in Virginia. Our police don’t bat an eye. VCDL's website has a list of the places that you cannot carry. And, here’s another good reason to open carry: McAuliffe and Herring HATE open carry. But, hey, it was THEIR brilliant idea to prohibit concealed carry, so they will have no choice but to get used to a whole lot more people open carrying in Virginia! 😉
  • 2. You can have a LOADED handgun in a CLOSED, but not necessarily locked, compartment or container in a vehicle. That includes a glovebox, console, and trunk as long as the compartment or container has some kind of latch. Optionally the loaded handgun can be in plain sight, on the seat or on the dashboard. Again, if concealed it MUST be in a compartment or container and nowhere else. Upon exiting the vehicle, the loaded handgun can be holstered and carried in plain view or you can unload the gun and put it in a carrying case.
  • 3. You can get a Utah non-resident concealed handgun permit or you can get a Virginia non-resident concealed handgun permit. For the money and the fact that Virginia’s permit has now been degraded by the Attorney General, I’d go for the Utah permit.

Whatever you do, please don’t judge our great Commonwealth based on our current Governor and Attorney General.

VCDL is working to fix “Herring’s Folly” from several angles.

a) A bill on VCDL’s behalf has been introduced by Delegate Lee Ware and will be considered by the General Assembly, which convenes on January 14th (Lobby Day is on the 18th, BTW). This bill will change Virginia law to honor the CHPs from ALL states! Expect a matching bill to come from the Senate.

Yes, McAuliffe will probably veto it, but with your help, we will work to get as large a majority as possible to pass it. More on this in future legislative updates in January.

In the meantime, here is a link to the bill:

b) The General Assembly’s “Power of the Purse” can be used in different ways to help with this battle

c) We can possibly use the courts to override Herring and McAuliffe’s actions

d) There is a petition you can sign. Yes, Herring will ignore it, but it will make a great PR item, when I say something like, “X thousand of people signed a petition against Herring’s actions.” 7,283 have signed it so far and you guys are just learning about it! Here is the link:

Since Herring is making our lives miserable, we can return the favor. More on this next week. Oh, and Herring is going to run for Attorney General again in 2017. I’ll bet he’ll be surprised at just how good our memories can be!

As of 8 PM on December 23rd, 2,818 comments have been posted. All but a handful, if that many, are against McAuliffe’s gun ban!

That's nice, but we can do better. Get this link into the hands of others you know and get them to leave a comments opposing the ban. If you haven’t commented yet, now is a great time to do so. Click on the link and then click on “Enter a comment” to get started:

Here’s an article on McAuliffe’s state-agency gun ban and VCDL:

The buses are now confirmed and I will let you know where the pickup points will be, the times, and how to make a reservation. Please make this the biggest Lobby Day VCDL has ever had!

VCDL will be holding a long awaited membership meeting in the Richmond area. We will meet at the Glen Allen Library on Tuesday, December 29th at 7:00 p.m. The meeting room will be open to us at 6:30 p.m. for fellowship and the meeting will begin around 7:00.

We will be discussing strategy for Lobby Day and the implications of the recent “audit” by AG Mark Herring and the Executive Order #50 issued by Gov. McAuliffe.

We will adjourn at 8:30 and those who care to will go to the Nuevo Mexico restaurant for continued fellowship.

The meeting is open to all, regardless of your membership status. In fact, we encourage you to bring people who have never been to a VCDL meeting before.

    1. The rotten apple doesn’t fall far from the ROTTING tree… I am sure all my fellow Patriots reading this horror story remember that mccauliffe was the bag man for the CLINTON CRIME FAMILY FOREVER AND AS FAR AS I AM CONCERNED STILL IS…
These are sick, sick people. They have no morals, no ethics, they no nothing but lies.

    2. Hey you all! In AZ where I live, we have concealed carry via permit. BUT, we also have CONSTITUTIONAL CARRY- CARRY CONCEALED WITHOUT A PERMIT. We also have open carry.
Besides, for the last 10 days the temperatures have been in the 80’s. It’s supposed to be this way for another 10 days at least. Come on down!

    3. Its time to boycott Virginia and Maryland .Do not spent a dime at their beaches! If they get no money coming in then maybe we can bankrupt their states.Hurt them in the pockets.

    4. A huge problem is the locusts that move from the ruins and nazi getto’s of Ny,NJ, Ma to the southern states and expect us to change to your rediculous liberal views. It’s like the plague but more destructive.

    5. Been to VA a few times vacationing. Will never go there again. Too bad these two have allowed Bloomberg’s money to subvert an otherwise important and useful constitutional right.
This is happening in all states Bloomberg has his money minions working against American rights for their profit. Always under the guise of “grassroots”. Vermonters withstood them all and they are back again this year with more state by state legislative subversions to undermine America’s greatness. One only needs to look to the most restrictive gun states and cities in America to see these “rules” work against the safety of citizens and play into the hands of criminals. I have a Utah CCW permit but still will not travel to VA, regardless. I don’t reward subversions to the constitution. I won’t even travel through your state anymore. Sorry to say it is very clear the democrats have an agenda and that should speak volumes to the voters and citizens whom do not vote. It is time to wake up and smell the coffee.

    6. It is times like this I am glad I was raised in West Virginia. I knew there was a reason my forefathers broke away from you people. Sorry you people have another STUPID DEMOCRATE running things, and as for the people that didn’t vote in your last election because it didn’t COUNT look what you got. This is just the beginning, puppet will do what Comrade Obama and Bloomberg wants on this issue. Of course none of us are safe from these fools. People better wake up before it is too late if it isn’t already. I live in Ohio now a little safer but not by much. Just wish I didn’t have to drive through USSR of Virginia to visit my son serving our nation.

    7. Thanks for the information. My wife and I, both of us in our seventies, visit family in VA about every two years. When we go we usually stay 7 to 10 days. While there we buy gas, food, and miscellaneous things. With the new law starting February 1st, wherein Virginia will not respect my CCW permit, I fear that we must stop our visits. Number of reason, here, Virginia: 1. by enacting this law you will be making me a criminal just by driving into your state. 2. By your law you disrespect and belittle my state (PA), 3. you belittle and disrespect me as a person, who has brought a concealed weapon into your state for the past 20 years without a single incident occurring because of me and my concealed weapon. 4. Because of an incident which occurred maybe forty years ago on I-10 in Mississippi at around 0230hrs. I have made it my business to never be on the road, after dark, without a means of self defense. So you see my dilemma. I doubt that your law will do much except cost your state some out of state visitors and revenue and, of course, the loss of good will by many, many Americans,

    8. As far as I’m concerned, the best advice is “when Virginia honors my CCW permit, then I’ll visit. Until then, there are plenty of places that are more deserving of my vacation and tourist money.”

    9. I lived in Virginia for 25 years before moving to SC. My wife is from VA and has family there so we visit often. I have family in WV so we are traversing the state often. I have enjoyed the many opportunities to hunt in VA while living there. I, like many others, will still need to visit VA but I’ll be as stingy as I can on making any purchases there that are not necessary……..

Be sure that the person you give your very, very valuable vote to is on your side of ALL ISSUES!

    11. We normally visit and drive through Virginia six times a year. We have favorite spots where we spend time and money. We will not stop or spend any money in Virginia until this injustice is corrected. A loss to both Virginia and us because of just two idiots.

    13. Well the people of Virginia can look into empeaching them both. Then hold a special election to put in officials that will be sympathic to the population of Virginia. This is not only for Virginia and other states but for the whole country. We the people of the US need to start looking at our officials before we put them into office. We need people that will work for the people of the US and take there oath of office and to obey the constitution not go off on there own.

    14. All this talk is in vane UNLESS you get out and vote. That is a great big part of why we are in the mess we are in.
It doesn’t take much longer to vote than it does to expound your frustrations here. I live in Tn. and I will avoid Va.
because there is a virus growing there called democrat control. We all better watch out for it, unless we want to be totally controlled.

    15. I am proud to be a longstanding member of the Virginia Citizens Defense League (VCDL) and I offer my apologies to out-of-state permit holders for our AG’s ruling. Please be aware that we have to deal with the big, Liberal counties up near the Maryland and DC lines when electing people like this, but most districts are very pro-Constitution in terms of the state legislature. Trust me that we are fighting this, and we have an excellent track record with our very Second Amendment friendly state legislature in fighting for our Constitutional rights. I do agree with the recommendation to get a Utah permit. I lived in Utah for many years and they get it. Everybody has a right to protect themselves.

    16. Upon my next opportunity to travel through VA I mostcertainly will open carry, fully loaded and w/extra ammo up and down every inch of public property I can. What a bunch of numb-skulls.

    17. I have one word for my fellow Virginians, RINO’s. That is why a liberal New Yorker is our Governer. It is mostly in Northern VA, but we now have a despicable crowd of them in Southwest Va. They (RINO’s), are the reason our past AG, is not our present Governor. Mr. Cuchinelli was thrown under the bus to pacify their liberal friends, for financial profit. Red Herring, well, he is so glad to be in office, nothing is beneath him. His narcissistic mind, know’s no boundaries. And, he jumps to the beat of Bloomberg’s money drum, just as little M. Kaine did, and T. Mac does now. They simply are not, and never have been honorable men. They have crucified McDonnell, for actions, that were child’s play, compared to T mac’s business dealing’s. My apologies to my neighboring states, and, I support your view and your reactions. As a Virginian I feel this is nothing less than low treachery, from low treacherous men. The bright side to this mess is this. We still have honorable statesmen, such as the Honorable Bill Carico, who are bravely standing up to these people. And they are others, who stand also. On lobby day, tell these men you support and defend them also, as true patriot’s. They need to know we are there for them, just as we are against many others. Never fail to call out, liberals, and RINO’s, as I assure you, they will attack you for your convictions. Lastly, if you have any faith in a creator at all, pray for our state, and our country. We have strayed far from our original path in this great experiment. We have had Gods blessing, we have had his judgement, I fear now we will know his wrath, and judgement.

      Support your Oathkeepers, get involved.

    18. I don’t live in Virginia but I traveled there once when I a teenager and I thought it was nice. I’m from Arkansas and I can tell you what your Governor and Attorney General says about Arkansas CHL’s is wrong. Here in Arkansas we have to complete a Concealed Carry class by a licensed NRA instructor which includes showing proficiency with our carry firearm. We must also submit a passport quality photo and finger prints to the state police when we apply for the license. We’re not just a bunch of backwoods Rednecks that carry our guns around and shoot at anything that moves. I sorry that your Governor and Attorney General don’t understand that fact.

    19. I believe a person doesn’t have only a right to defend themselves, family and property, They have an OBLIGATION to defense. No law has the authority stop you.

    20. Most of my pleasure time and shopping is in Virginia, seems this will cease, I have concealed NC Permit therefore I feel we will be targeted by license checks by Highway Patrol to see if the weapons are with us. Just need to limit my travels to VA.

    21. It would be nice to have a list of products produced in VA to avoid buying. Pressure needs to be applied to the non government employees and companies. Only then will you get the citizens of VA to vote to rid the state government to rid itself of these roaches.

    22. Part of your article is WRONG! It is NOT legal to carry a loaded handgun in a glovebox or center console, regardless if it has a latch or not. If it is within reach of the driver or occupant in the vehicle (both the glovebox and center console) it is illegal unless you have a CCW permit.

    23. I have family that live in Virginia plus my wife and myself love to travel to Virginia, but I guess all family reunions and traveling will be put on hold until this travesty is resolved

    24. I don’t get people who want to restrict guns, but don’t want to restrict criminals. The gun is nothing more than a tool, like a hammer or a screwdriver. Both are capable of killing, but not by themselves. These same people fail to understand guns have settled this country, it kept it free, it rid the world of people like Hitler and other dictators. They have protected many a Police Officer, and a healthy amount of homeowners, and provided food for families since the first gun was produced. These same fools would have you standing there, with your hands in your pocket and the water falling on the floor, while you helplessly watch your family harmed. All so that they can bathe in their misguided notion that getting rid of legal guns will make their world safe. We need to rid ourselves of these fools. If their store carries a “no weapons allowed” sign…shop somewhere else. If they are elected officials….get them out of office. We need to be rid of the candy-ass tree huggers who think all you have to do is smile and the whole world will smile with you….smile at a criminal and see what you get.

I am a concealed carry permit person, I am a sheepdog. You act right and we won’t have any problems. You harm mine…you will lay upon the Earth until you are buried in it.

    25. Well for the fact I have always open carried. So it really doesn’t hurt me any. To let others know you can OC in VA, without a permit. It will eventually hurt Virginians going to other states. To let you know you can OC in NC WITHOUT a permit. So onward OC

    26. Here’s an idea. How about on Monday, February 1st, the very day this policy of the Virginia AG goes into effect, let’s have a rally on the steps of the Capital in Richmond made up of people from out of state (as well as like minded Virginians) whose Concealed Carry Licenses or Permits are no longer valid in Virginia. Make it an Open Carry Rally, everyone have an obvious pistol open carry holstered. Our message will be clear. Don’t want to see our guns? This is the only way, Open Carry, that we can be armed in Virginia now.
