Red Flag Bill Is BACK In The Colorado Legislature, Every Gun Owner Is At Risk!

Colorado – -(AmmoLand.com)- Last legislative session a Red Flag bill died in committee, but we knew it would be back. And it is. This time is worse than before and it should have every gun owner or gun rights supporter worried.

This year’s bill is being called an “Emergency Risk Protection Order” or ERPO in an attempt to lose the negative “Red Flag” reputation. It is also being pushed more than ever as being about suicide prevention. Don’t let any of it fool you. The devil is in the details; it’s in the 30 pages of bill language. Here’s what you’ll hear the media say this bill does:

“A family member or law enforcement officer would petition a court to request the ability to immediately seize a person’s guns. If a judge signs the order, the weapons can be taken away and the court must hold a hearing within 14 days to determine whether to extend the seizure and bar the person from purchasing more firearms.”

Here’s what they won’t tell you:

  • Almost anyone can request an ERPO without even showing their face or providing their address. The definition of “family or household member” is so broad it includes ex-lovers who you have never even lived with! Or someone *claiming* you once had an affair. And even old roommates.
  • The initial report and hearing can be done over the phone, all while the accused is completely oblivious proceedings are taking place to have his or her firearms confiscated.
  • The first time the accused learns someone has reported them will be when local law enforcement shows up at their door with an order AND a search warrant prepared to raid your home – while the accused never even committed a crime.
  • 14 days later is the first time the accused will have a chance to defend themselves against this non-crime.
  • The guns will be confiscated for 364 days, during which time the accused only has one opportunity to ask the courts to lift the order.
  • There is zero accountability for false accusers. In fact, the filing fee is $0! For comparison, requesting a Temporary Restraining Order in Colorado is $97.
  • This bill is being touted as a “suicide prevention” bill, when in fact, the fear of having your firearms confiscated will make people terrifed to ask for help when they need it.
  • It is so ripe for abuse, it can easily be used by someone’s stalker or abuser to have their victim disarmed – legally.
  • The ERPO will go on a person’s permanent record EVEN if it is dismissed, meaning it will show up on background checks, etc.

If one passes here that will give the person that lives several doors away a good way to get me for shooting in my back yard/woods. They don’t like the noise. They have called the sheriff on me twice but this would give a sure way to get me.

Can’t shoot in my neighborhood as I live within the city limits, which should well be. You may want to go visit with your hat in hand and tell them your’e shooting. The ERPOs that a few worry about are just this. Needless worry.

@GWD Good for you, you belong in the city and you act just like city dwellers. Would you like a metal or a chest to pin it on. For your information I live in the county and shooting is legal, in fact there are several of us that shoot here. One guy is a retired Navy Seal and he has a permit for the big stuff. Matter of fact, a black Chevy Suburban pulled in his driveway one night with the intention of confiscation and he put the paper in front of them to show them and send them back… Read more »

@Tcat, Aguilla makes Colibre .22 LR ammunition that has no powder in it. It flies straight enough to shoot at paper targets and makes almost no noise out of a rifle. Inexpensive too! Midway is having a free shipping sale, currently.

Our 2nd Amendment President-Donald J. Trump, gun organizations such as the NRA, strong bipartisan support by government officials, overwhelmingly support from students at our colleges, and overwhelmingly support by the American public: We support ERPOs. We are taking action in protecting ourselves, others, and from those wanting to hurt themselves. We believe our right to bear arms, for instating ERPOs, will not be infringed.

Your comment is illogical and unconstitutional, and a violation of my 4th, 5th, & 6th amendment civil rights. Any law which allows anonymity deprives me of confrontation of that accuser & accusation in front of a judge, this is legalized slander & libel. Keeping my property without due process and appeal process is a violation of the 14th amendment. Keeping my name on a list which is used in further background checks 6th amendment civil rights. Now, if it passes, file a red flag complaint against every lawmaker who voted for it. They are a danger to our freedom. Let them be the first subjected to a no-knock raid and a confiscation of all of their firearms and the firearms of those around them.

Feb. 21 is not far away. If this bill passes, then expect a domino effect across our nation with remaining states. The ERPO has safe guards in place where reporting an incident is taken quite seriously, and a thorough investigation is conducted. Yes, false reports can be expected, but will be quite low.

GWD your first two statements are entirely true. The rest are a bunch of crud. There are NO safeguards for the victim of an ERPO. There is nil investigation conducted before the illegal confiscation is executed. As for your guess that the false reports (which have zero consequences for those lying to the police) will be quite low, we have just seen yet another hate crime hoax committed. Jesse Smollett is potentially facing up to 3 years in jail and that was not enough of a deterrent to prevent the hoax. How much more common will false ERPOs be with… Read more »

These ERPOs are making gun confiscation legal. The list of people able to ask for one is so long and ambiguous that your 2nd grade teacher could turn you in, and of course with no repercussions if they were lying. The LEOs will issue them out of an ‘abundance of caution’ leaving the gun owner with an expensive and lengthy legal battle.

Frankly, They scare the hell out of me. Michigan (my home State) is working on getting one passed now too. I have a 38 yr old estranged daughter with mental health issues that I have not had contact with for more than 4 years( don’t know where she is and don’t care to know either).
